Barone is far too sanguine about the state of racial justice with regard to voting. There are far too many anecdotes about barriers set up in black communities in recent elections, there is far too deep a history in some areas of the country on matters of descrimination that, Barone's assertions to the contrary, did not end by 1968, etc. I do, however, agree with him that we should not just take a knee jerk approach that says that we must reinstate every element of the VRA. At the same time, Deep South States made their bed over the course of a century or so of Jim Crow. If we are going to err one way or the other, I see no harm in erring on the side of caution but perhaps having a sunset provision that says that this is the last renewal.
